SMS Communication & Consent

1. Purpose

Atlas Managed Care ("Atlas") uses Short Message Service (SMS) text messaging as one channel to communicate with injured workers, employer contacts, claims administrators, and providers about workers' compensation claims, treatment authorization, care coordination, and case status. This policy explains how Atlas obtains your consent before sending SMS messages, what kinds of messages we send, and how you can opt out at any time.

2. Telephone Numbers Used by Atlas

Atlas sends and receives SMS messages from the following toll-free numbers, each dedicated to a specific service line. Each number is registered with the carriers and verified under the U.S. toll-free messaging program.

3. Consent (Opt-In)

Atlas does not send unsolicited marketing SMS messages. Before we send you any SMS message, we obtain your explicit consent through one of the following methods:

3.1 Verbal Consent

During an inbound or scheduled call with an Atlas representative, you may be asked: "Is it okay if we follow up with you by text message about your case?" If you say yes, your verbal consent is documented in our call record with the date, time, and phone number provided.

3.2 Written or Electronic Consent

When you complete an Atlas intake form, online portal sign-up, or paper consent form, you may check a box indicating you agree to receive SMS messages from Atlas about your case. The checkbox is unchecked by default and your consent is recorded with a timestamp.

3.3 Provider, Employer, & Business Contact Consent

Providers, claims adjusters, employer contacts, and attorneys who exchange SMS messages with Atlas have consented in the course of their business relationship with Atlas, typically when initiating contact or providing their cell number for case communication.

4. Types of Messages You May Receive

SMS messages from Atlas fall into the following categories only. We do not send promotional or marketing messages, and we do not share consent or phone numbers with third parties for any purpose.

5. Message Frequency

Message frequency varies based on the activity on your case. A typical injured worker receives between two (2) and eight (8) SMS messages per month during an active claim. Business contacts (adjusters, providers) may exchange more frequent messages depending on case volume.

6. Standard Carrier Charges

Standard message and data rates may apply to messages you receive from Atlas. Atlas does not charge any fee for our SMS messages. Contact your wireless carrier for information about message and data rates on your plan.

7. How to Opt Out

You can opt out of SMS messages from any Atlas number at any time:

Opt-out is honored within one (1) business day across all Atlas service lines for the phone number you opted out from. Note that opting out of SMS does not affect Atlas's ability to contact you by other means (phone, secure email, secure portal, postal mail) where authorized by you or required for claim administration.

8. Re-Opt-In

If you have previously opted out and wish to resume receiving SMS messages from Atlas, you may reply START to any Atlas number, complete a new intake/consent form, or contact Atlas directly to provide renewed consent.

10. Privacy & Security

SMS messages are not an encrypted communication channel. Atlas limits the content of SMS messages to non-sensitive case identifiers, scheduling, and links to secure portals. We do not send full Protected Health Information (PHI) or financial information by SMS. For details about how Atlas protects your information, see our Privacy Policy.

11. Compliance

Atlas's SMS practices comply with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, the U.S. carrier toll-free messaging program rules, the California Consumer Privacy Act (CCPA), and HIPAA where applicable. All Atlas toll-free numbers used for SMS are registered and verified with the U.S. carrier consortium.

12. Changes to This Policy

We may update this SMS Communication & Consent Policy from time to time. The most current version will always be posted on this page with an updated "Last Updated" date. Material changes will be communicated to active SMS subscribers where required by law.
