1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website located at atlasmanagedcare.com (the "Site"), the toll-free voice and SMS service lines listed in our SMS Communication & Consent Policy, and any related services provided by Atlas Managed Care ("Atlas," "we," "us," or "our"). By accessing the Site, calling our toll-free numbers, exchanging SMS messages with our service lines, or otherwise interacting with our services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Site or our services.
2. About Atlas Managed Care
Atlas Managed Care is a California workers' compensation managed care company. We provide triage, employee advocacy, nurse case management, utilization review, bill review, Medical Provider Network (MPN), and Medicare Set-Aside services to injured workers, employers, claims administrators, and providers.
We administer utilization review services under a written delegation agreement with Arissa Cost Solutions, a URAC-accredited Workers' Compensation Utilization Management Organization. Atlas itself maintains organizational practices designed to align with URAC and HIPAA standards.
3. Eligibility
The Site and our services are intended for use by injured workers with active California workers' compensation claims, employers, claims administrators, attorneys, providers, and other authorized business contacts. By using our services you represent that you are at least 18 years of age, or if you are under 18, that you are an injured worker accessing services in connection with a workers' compensation claim, with the involvement of a parent or legal guardian where required by law.
4. Services Provided
Atlas provides administrative and care coordination services in connection with workers' compensation claims. Specifically, Atlas:
- Operates a first-touch injury triage line for newly injured workers.
- Coordinates care between injured workers, treating providers, employers, and claims administrators.
- Administers utilization review activities under written delegation with a URAC-accredited UM organization.
- Manages a Medical Provider Network (MPN) and routes injured workers to in-network providers.
- Performs bill review and Medicare Set-Aside (MSA) services.
- Sends and receives appointment reminders, status updates, document requests, and case follow-ups by voice and (with opt-in) SMS.
Atlas does not provide medical advice, diagnose conditions, or render treatment. All clinical decisions remain the responsibility of licensed treating providers and, for utilization review determinations, licensed peer reviewers operating under our delegated UM agreement.
5. Not Medical or Legal Advice
Content on the Site and communications from Atlas representatives are for informational and care coordination purposes only. Nothing on the Site or in any Atlas communication constitutes medical advice, legal advice, or a substitute for professional consultation with a licensed physician or attorney. Always consult your treating provider for medical decisions and a licensed attorney for legal advice about your workers' compensation claim.
6. SMS and Voice Communications
Use of our SMS service lines is governed by our SMS Communication & Consent Policy, which is incorporated into these Terms by reference. By providing your phone number and opting in (in writing or verbally during a recorded call), you consent to receive SMS messages from Atlas about your case, subject to the rights described in that policy. Standard message and data rates may apply. You may opt out at any time by replying STOP to any Atlas SMS message.
Voice calls to and from Atlas may be recorded for quality assurance, training, regulatory compliance, and audit purposes, where permitted by law. Where required by California law, you will be notified at the start of the call.
7. Privacy
Atlas's collection, use, disclosure, and protection of personal information and Protected Health Information are described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Acceptable Use
You agree not to use the Site or any Atlas service to:
- Violate any applicable law, regulation, or third-party right.
- Impersonate another person or misrepresent your affiliation with any person or entity.
- Submit false, misleading, or fraudulent information in connection with a workers' compensation claim.
- Transmit malware, viruses, or any code designed to disrupt or compromise our systems.
- Attempt to gain unauthorized access to any portion of the Site, our infrastructure, or another user's account or claim data.
- Interfere with or disrupt the integrity or performance of the Site, our voice lines, or our SMS service lines.
- Use automated systems (bots, scrapers) to access the Site or our services except as expressly authorized in writing by Atlas.
9. Intellectual Property
The Site, including its text, graphics, logos, page layouts, and underlying code, is the property of Atlas Managed Care or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print portions of the Site for your personal, non-commercial use in connection with a workers' compensation claim. All other use, including reproduction, modification, distribution, or republication, requires Atlas's prior written consent.
"Atlas Managed Care" and the Atlas logo are trademarks of Atlas Managed Care.
10. Third-Party Services and Links
The Site may contain links to third-party websites and services (for example, secure portals operated by claims administrators, the California Division of Workers' Compensation, the HHS Office for Civil Rights, or our business associates). Atlas does not control and is not responsible for the content, privacy practices, or terms of any third-party site. Your use of any third-party site is subject to that site's own terms and privacy policy.
11. Disclaimer of Warranties
The Site and our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Atlas does not warrant that the Site, our voice lines, or our SMS service lines will be uninterrupted, error-free, or free of harmful components, except to the extent such warranties cannot be disclaimed under applicable law.
12. Limitation of Liability
To the maximum extent permitted by law, Atlas, its officers, directors, employees, contractors, and business associates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or service interruption, arising out of or relating to your use of the Site or our services, even if Atlas has been advised of the possibility of such damages.
In no event shall Atlas's aggregate liability arising out of or relating to your use of the Site (excluding liability arising from clinical or claim administration services provided under a separate written contract) exceed one hundred U.S. dollars ($100). The foregoing limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or violations of HIPAA, CCPA/CPRA, or California Labor Code obligations.
13. Indemnification
You agree to indemnify, defend, and hold harmless Atlas and its officers, directors, employees, and business associates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) your fraudulent or unlawful use of the Site or our services.
14. Termination
Atlas may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Termination of Site access does not, by itself, terminate Atlas's obligations under your underlying workers' compensation claim, which are governed by California Labor Code § 4610 and related law.
15. Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Exclusive venue for any dispute arising out of or relating to these Terms, the Site, or our services (other than claims that fall within the exclusive jurisdiction of the California Division of Workers' Compensation, the Workers' Compensation Appeals Board, or other administrative tribunal having statutory authority) shall lie in the state and federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.
16. Workers' Compensation Carve-Out
Nothing in these Terms limits, alters, or supersedes any right, obligation, or remedy provided under California Labor Code Division 4 (Workers' Compensation and Insurance), the regulations of the California Division of Workers' Compensation, or any final order of the Workers' Compensation Appeals Board. Disputes about the substance of a workers' compensation claim, including utilization review determinations subject to Independent Medical Review, are governed exclusively by the statutory and regulatory process for workers' compensation claims in California.
17. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last Updated" date. Material changes will be communicated to affected users where required by law. Your continued use of the Site or our services after the effective date of any update constitutes your acceptance of the updated Terms.
18. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be reformed to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
